Georgia landlord-tenant relationships are governed primarily by Title 44 of the Georgia Code, and while screening practices are permitted, the state does not impose a specific statutory cap on rental application or screening fees.
Fees: Georgia law does not establish a statewide maximum application fee. Landlords may charge screening fees but should disclose them in advance, ensure they are reasonable, and apply them consistently to all applicants.
Security Deposits vs. Fees: While application fees are not capped, Georgia law regulates security deposits separately and requires deposits to be held in escrow accounts with proper documentation and disclosures.
Consumer Reports: When using tenant screening reports, including credit checks, landlords must comply with the Fair Credit Reporting Act, including obtaining written applicant authorization prior to accessing consumer reports.
