New Mexico Tenant Screening Laws & Application Fee Guidelines

New Mexico landlords may use credit reports and tenant screening reports when evaluating applicants, provided they follow federal and state law. Screening criteria should be applied consistently and in compliance with Fair Housing and FCRA requirements.

Screening Fee Cap: New Mexico allows a screening fee that may not exceed $50 to cover the cost of obtaining information about the applicant, including a consumer credit report, reference check, or screening service.

Notice, Consent, and Receipt: Before charging the fee, the owner must provide written notice of the screening fee, obtain the applicant’s written agreement to pay it, and provide a written receipt.

Availability and Deposit Rules: The owner may not charge the screening fee when the owner knows or should know that the unit is not available for rent at that time or at the beginning of the residency. The owner also may not use, cash, or deposit the screening fee until prior applicants have been screened and rejected or offered the unit and declined.

Other Fees Prohibited: Aside from the screening fee, the owner may not charge other fees to process an application. The screening fee must be returned in the situations set out by statute, including when the owner does not obtain a credit report, perform a reference check, or use a screening service.

Authorization and Adverse Action: FCRA authorization and adverse action notice rules also apply when consumer reports are used.
