New York landlords may use credit reports and other tenant screening reports when evaluating applicants, provided they follow federal, state, and local rules. Screening criteria should be applied consistently and in compliance with Fair Housing and FCRA requirements.
Fees: In New York, landlords may charge a screening fee only to reimburse the actual cost of background and credit checks, and the fee may not exceed $20 per applicant.
Recent Applicant Reports: If an applicant provides a background check or credit check conducted within the past 30 days, the screening fee must be waived.
Copies & Receipts: Landlords may not collect the screening fee unless they provide the applicant with a copy of the report and the receipt or invoice from the screening provider.
