Oregon Tenant Screening Laws & Application Fee Guidelines

Oregon landlords may use credit reports and tenant screening reports when evaluating applicants under the Oregon Residential Landlord and Tenant Act, provided they follow federal, state, and local rules. Screening criteria should be applied consistently and in compliance with Fair Housing and FCRA requirements.

Application Fees: Oregon does not use a flat statewide cap, but applicant screening charges are tightly regulated. A screening charge may not be greater than the landlord’s average actual cost of screening applicants or the customary amount charged by screening companies or consumer credit reporting agencies for a comparable level of screening.

Required Disclosures Before Charging a Fee: Before accepting any screening charge, a landlord must adopt written screening or admission criteria and give written notice of the screening charge, the screening criteria, the screening process, dispute rights, any appeal rights, required nondiscrimination policies, the rent and deposits to be charged, whether renter’s liability insurance is required, and the applicant’s right to a refund under Oregon law.

Availability Notice and Refund Rules: A landlord may not require a screening charge when the landlord knows or should know that no rental unit is available at that time or within a reasonable future time, unless the applicant agrees otherwise in writing. Screening charges must be refunded within a reasonable time if the landlord fills the unit before screening the applicant or does not screen the applicant for any reason.

Receipts and Screening Confirmation: Oregon landlords must provide a receipt for any applicant screening charge. Promptly after each screening conducted by a tenant screening company or consumer credit reporting agency, the landlord must provide confirmation of the screening, including a copy of the receipt from the company or agency.

Eviction and Criminal History Limits: Oregon law limits how landlords may use prior eviction actions and criminal history in screening. Certain older or dismissed eviction cases may not be considered, and criminal history use is restricted by statute.
