Utah Tenant Screening Laws & Application Fee Guidelines
Utah landlords may use credit reports and tenant screening reports when evaluating applicants, provided they follow federal and state law. Screening criteria should be applied consistently and in compliance with Fair Housing and FCRA requirements.
Required Written Disclosures Before Accepting Money: Before an owner accepts an application fee or any other payment from a prospective renter, Utah law requires written disclosure of a good-faith estimate of rent and fixed non-rent expenses, the types of use-based non-rent expenses, the expected availability date, the criteria the owner will use to evaluate the applicant, and the process to recover money paid in relation to the unit.
Refund Rights: A prospective renter may make a written demand for return of money paid if the amounts or types of charges disclosed in the good-faith estimate differ from the rental agreement, so long as the demand is made within the statutory time and before the renter signs the lease or takes possession. The owner must return the money within five business days after receiving the written demand.
Authorization: Landlords must obtain applicant authorization before obtaining consumer reports, including credit and background checks.
Adverse Action Requirements: If an applicant is denied based on a consumer report, landlords must comply with FCRA adverse action notice requirements.
