Washington Tenant Screening Laws & Application Fee Guidelines

Washington landlords may use credit reports and tenant screening reports when evaluating applicants under the Residential Landlord-Tenant Act, provided they follow federal, state, and local rules. Screening criteria should be applied consistently and in compliance with Fair Housing and FCRA requirements.

Pre-Screening Disclosures: Before obtaining any screening information, Washington landlords must first notify prospective tenants in writing, or by posting, what information will be accessed, what criteria may result in denial, the name and address of the consumer reporting agency if a consumer report is used, and whether the landlord will accept a comprehensive reusable tenant screening report.

Application Fees: A landlord may charge a prospective tenant for screening costs only if the required disclosures are provided first. If the landlord conducts its own screening, the amount charged may not exceed the actual costs incurred and may not exceed the customary costs charged by a screening service in the general area.

Reusable Screening Reports: Washington law specifically addresses comprehensive reusable tenant screening reports. If a landlord indicates a willingness to accept one, the landlord may access the landlord’s own screening report only if the prospective tenant is not charged for that landlord-obtained report.

Adverse Action Requirements: If a landlord takes adverse action, Washington law requires a written adverse action notice stating the reasons for the decision. When the decision is based on a consumer report, the notice must also include the reporting agency information, and federal law gives applicants the right to request a free copy of the report and dispute inaccuracies.

Website Disclosure: A landlord that maintains a website advertising a dwelling unit or serving current or prospective tenants must state on the property’s home page whether the landlord will accept a comprehensive reusable tenant screening report.
